Terms of Service

These Terms are between you and Upwind ("we", "us", "our") and govern your use of the Upwind website, dashboard, and browser extension (together, the "Service"). By creating an account or using the Service, you agree to these Terms.

What Upwind does

Upwind helps superyacht crew apply to jobs faster. It scans job postings you paste in or that its browser extension finds on Yotspot, generates draft cover letters and screening answers from the bio you provide (using AI), tracks recruitment agencies you tell it about, and can optionally scan Yotspot in the background on a schedule you choose.

AI-generated content is a draft, not advice

Cover letters, screening answers, and match-fit scores are generated by AI based on the bio and job details you provide. We don't guarantee they're accurate, complete, or free of errors, and you are solely responsible for reviewing them before they're used in any real application. "Land it" only submits a real application to Yotspot on your behalf once you've reviewed that specific job's cover letter yourself, or after you've explicitly confirmed a warning covering any not-yet-reviewed jobs included in a bulk "Apply to all". It never submits anything on a third-party agency's own site — those tabs are opened for you to send yourself.

The browser extension

The Upwind Chrome extension reads pages within your own, already-logged-in browser session (for example, Yotspot search results and job postings) so it can find and stage matching jobs. It also fills in the cover-letter field on a Yotspot job page and, subject to the review/confirmation rule above, clicks Yotspot's own "I'm Interested" button — this is the only submit action it ever performs, and only on Yotspot's own page. It never fills in or submits a form on any third-party agency site. We never see or store your Yotspot password.

Accounts and subscriptions

Upwind offers a free tier with limited monthly scans and cover letters, plus paid Pro and Unlimited plans and optional one-time "burst" add-ons for faster scanning, billed through Stripe. You can cancel or change your plan at any time from your dashboard; cancellation takes effect at the end of your current billing period. We don't store your card details ourselves — Stripe handles all payment processing.

Third-party sites

Upwind is not affiliated with, endorsed by, or operated by Yotspot or any recruitment agency referenced in the Service. Your use of those sites is governed entirely by their own terms. We aren't responsible if a third-party site changes, blocks access, or is unavailable, and we don't guarantee any job application will be seen, shortlisted, or successful.

Automated scanning may breach Yotspot's or an agency's own terms of use. The browser extension's Yotspot auto-watch feature reads pages through your own logged-in session on a schedule, which most job boards' terms technically restrict. Using it is entirely your choice and at your own risk — if Yotspot or another site detects automated access, they may rate-limit, flag, or suspend your account there. We aren't responsible for any action a third-party site takes against your account with them as a result of using the Service.

Acceptable use

Don't use the Service to abuse, overload, or attempt to circumvent rate limits or security controls on Upwind or any third-party site; don't attempt to reverse-engineer the Service; don't resell or share your account access; don't use the Service for anything unlawful.

Your content

You retain ownership of your bio, CV, and any content you submit. By using the Service you give us permission to process that content (including sending it to our AI provider) solely to provide the Service to you, as described in our Privacy Policy.

Disclaimers and limitation of liability

The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, or for any employment outcome, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim arose.

Termination

You can stop using the Service and delete your account at any time by contacting us. We may suspend or terminate access if we reasonably believe these Terms have been breached.

Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after a change means you accept the updated Terms.

Governing law

These Terms are governed by the laws of England and Wales.
